The LGBTQ+ Fostering Series: What If I Have a Criminal or Legal History?

3 June 2025 | The LGBTQ+ Fostering Series

Having a criminal record doesn’t automatically mean you can’t foster. It all depends on the nature of the offence, how long ago it happened, and the person you are today.

All applicants must undergo an enhanced Disclosure and Barring Service (DBS) check. Some offences—particularly those involving children or violence—are likely to prevent fostering. But many others, especially if they occurred years ago and are clearly in the past, are not necessarily barriers.

At St David’s, we ask you to be honest from the outset. Tell us about any past incidents, even if you’re not sure whether they’ll show up. We want to have open, non-judgemental conversations where we can understand context, what you’ve learned, and how you’ve changed.

LGBTQ+ individuals, especially trans applicants, may have additional concerns about privacy and how their identity is represented in background checks. Our team is experienced in supporting people through this process, and the DBS has a Sensitive Applications Team available to help.

We also have access to a legal advisor who can offer guidance where needed. Our priority is always the safety and wellbeing of children, but we also believe in second chances and in people’s capacity for growth.

If you’ve made mistakes in the past but are now in a stable, caring place—don’t rule yourself out. Let’s have a conversation and find out what’s possible.

Ready to Take the Next Step?

Fostering is one of the most meaningful, life-changing things you can do. If you’ve been sitting with questions or doubts, we hope this series has helped clear the fog.

No matter your background, health, or history, if you have the compassion and stability to offer a child a safe and loving home, we’d love to hear from you.

To start a conversation, reach out to our team at St David’s. We’re here to listen—and ready to walk alongside you, every step of the way.
